Terms of Use and Sale

This is a generic template prepared for launch. Review with counsel before relying on it. The returns section is marked "to be finalized".

1. The company

This website and the products on it are offered by APEX Yard and CO LLC, a Wyoming limited liability company, 30 N Gould St Ste R, Sheridan, WY 82801, USA ("Apex", "we"), trading as Apex Indoor Golf.

2. Quotes, not orders

The website does not process payments. Submitting a quote request is not an order and creates no obligation on either side. A contract of sale is formed only when you accept a written quote by email and we confirm it with an invoice. Quotes are valid for 14 days unless stated otherwise; manufacturer price changes, stock changes and freight rate changes before acceptance may require a revised quote.

3. Prices

All prices are in US dollars. Launch monitors and projectors are sold at the manufacturer's minimum advertised price or unilateral pricing policy in force on the quote date. "Compare at" prices are explained on each product page and are not our former prices. Prices on the website exclude freight, installation and sales tax, which are itemized on the quote. Where a product page shows a price range or "call for current price", the quote states the exact price.

4. Apex store credit

Store credit stated with a launch monitor or projector applies only to Apex-brand enclosures, screens, mats and cages on the same quote or, if unused, on a later quote within 12 months. It has no cash value, cannot exceed the value of the eligible items, is not combined with package pricing and is void if the qualifying product is returned.

5. Room fit and your responsibilities

Room requirements on the website and fit checks in quotes are based on the dimensions you give us and on typical swings. You are responsible for measuring accurately, for confirming that the ceiling, floor and walls can support the equipment, for electrical supply, and for complying with local building codes. Golf simulators involve clubs and balls moving at high speed; use them with appropriate care and keep bystanders clear of the hitting area.

6. Delivery

Risk of loss passes to you on delivery to the address on the invoice. Freight deliveries are curbside with lift gate unless the quote states otherwise. Inspect freight on arrival and note any damage on the carrier's delivery receipt; report concealed damage to us within 3 days of delivery with photos. Delivery dates are estimates.

7. Installation services

Professional Install & Calibration is performed by Apex or by partner installers acting on our behalf, according to the scope on the product page and the quote. Electrical work, drywall, custom carpentry and travel beyond the quoted radius are not included unless listed. Scheduling depends on delivery of all components.

8. Warranties

Branded products carry the manufacturer's warranty; we will help you with claims but the manufacturer's terms govern. Apex-brand products are warranted for 12 months from delivery against defects in materials and workmanship; impact screens, nets and turf are wear items and are not warranted against marks, wear or damage from use. The optional Extended Warranty is governed by its own terms supplied with the quote. EXCEPT AS STATED HERE, PRODUCTS ARE PROVIDED WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.

9. Returns and cancellations

To be finalized before launch. Working policy: orders may be cancelled without charge before shipment. Unopened launch monitors and projectors may be returned within 30 days of delivery for a refund less return shipping; opened units are subject to the manufacturer's return terms and a restocking fee stated on the quote. Unused Apex-brand products in original packaging may be returned within 30 days with return freight at the customer's expense. Installation services are non-refundable once performed, and custom-cut items are non-returnable. The final policy will replace this paragraph.

10. Limitation of liability

To the extent permitted by law, our total liability for any claim relating to a product or service is limited to the amount you paid for it, and we are not liable for indirect, incidental or consequential damages, including damage to the room in which equipment is installed or used.

11. Website use

Content on this site, including the Apex name, wordmark, text and diagrams, belongs to Apex or its licensors. Brand names of third-party products belong to their respective owners and are used to identify the products. Specifications are summarized from manufacturer materials and may change; where we are still verifying a specification we say so on the quote. You may not use the site to scrape data or to interfere with its operation.

12. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Sheridan County, Wyoming, unless applicable consumer law gives you the right to bring it elsewhere.
